In 2007, federal prosecutors prepared a 53-page indictment that would have charged Epstein with sex trafficking. Instead, US Attorney Alex Acosta negotiated a secret non-prosecution agreement (NPA) that gave Epstein and his co-conspirators immunity from federal prosecution. Acosta later said he was told Epstein "belonged to intelligence" — a claim that has never been officially confirmed or denied.
Following the 2026 file releases, the DOJ indicated it has no plans to prosecute additional Americans. Representative Ro Khanna (D-CA) stated publicly that the files appeared to have been "scrubbed to protect elite, powerful men."
The 2008 plea deal was ruled illegal in 2019 by a federal judge (it violated the Crime Victims' Rights Act by not notifying victims), but by then Epstein was dead.
